Texting Terms of Use

THIS IS A LEGAL AGREEMENT BETWEEN YOU AND FLOWER ORTHOPEDICS CORPORATION (D/B/A CONVENTUS FLOWER ORTHOPEDICS) (“CONVENTUS” OR “WE” OR “US” OR “OUR”). BY OPTING IN TO RECEIVE SMS MESSAGES FROM CONVENTUS, YOU AGREE TO THE FOLLOWING TERMS:

Message Frequency
You may receive recurring messages related to promotions, account updates, alerts, etc. (the “Campaign”). Message frequency may vary, but the text messages will continue on a recurring basis unless/until you opt out prior to the completion of the text promotion Campaign.

Your Acknowledgments

You represent that you are the account holder for the mobile telephone number(s) that you provide to opt in to the texting Campaign.  By consenting, you authorize Conventus to deliver or cause to be delivered the text content associated with the Campaign using automated technology, which may include an automatic telephone dialing system. Consent to receive marketing text messages is not required as a condition of purchasing any products, and you understand that providing this consent is not required or a condition of purchasing any products.

Opt-Out
You can opt out of receiving further texts related to the Campaign by replying “STOP” to any message from the Campaign. You understand that you will, however, receive a response from us either confirming receipt of your request or seeking clarification of your request. If you are enrolled in multiple campaigns, please note that replying “STOP” to a text message from the Campaign will discontinue only texts from this Campaign, and not any other campaigns or text groups you may be enrolled in.  To request more information or for help, reply HELP or contact [email protected].

Message & Data Rates
There is no fee charged by Conventus to receive Campaign messages, but Message and data rates may apply as per your mobile carrier plan.  Please consult your mobile service provider for the terms and conditions under which charges are billed and payable.  Conventus is not responsible for any charges from your mobile provider.

Privacy
Any of your information that may be collected will be used in accordance with our Privacy Policy. We do not share your mobile number with third parties for marketing purposes.

Eligibility
You must be at least 18 years old or have parental consent to use this service and to subscribe to the Campaign.

Supported Carriers
Messages may not be available on all carriers. Delivery is subject to carrier availability.

Changes to these Terms of Use
We may update these Terms of Use at any time.  Any modifications to these Terms of Use will be effective upon our posting the modified version (or as otherwise indicated at the time of posting).  You are encouraged to periodically review these Terms of Use.  Continued receipt of the Campaign texts constitutes acceptance of any such changes.

Additional Terms

Conventus does not guarantee the successful delivery of any Campaign messages. Various factors beyond the control our may impact message delivery, including equipment range, network capacity and location.  Conventus shall have no liability for delayed or undelivered messages.
